These Terms of Service ("Terms") govern your access to and use of draftech.com and any page, article, tool, download, or form hosted on it (the "Site"), which is operated by Draftech International, LLC ("Draftech," "we," "us," or "our").
By accessing or using the Site, you agree to these Terms. If you do not agree, please discontinue use of the Site. These Terms apply to the Site itself. They do not replace or amend any signed proposal, master services agreement, purchase order, or statement of work between you and Draftech; where a signed agreement covers the same subject, that agreement controls.
You may view, browse, and print pages of the Site for your own business or personal reference. In using the Site, you agree not to:
We may change, suspend, or withdraw any part of the Site at any time without notice, including removing or revising articles, calculators, and downloads.
The articles, guides, checklists, templates, service descriptions, and reference material published on the Site are general information about outside plant and telecom engineering practice. They are written to help readers understand common methods, terminology, and planning considerations.
Site content is not a stamped or sealed engineering deliverable. It has not been prepared for your specific project, site conditions, jurisdiction, utility standards, or governing codes, and it is not signed or sealed by a licensed professional engineer for your use. Nothing on the Site constitutes an engineering opinion, certification, design approval, permit submission, or legal advice.
A stamped deliverable is produced only under a written engagement, for a defined scope, using project-specific inputs, and issued to a named client. If you need a sealed design, a pole loading analysis of record, a permit package, or an as-built set for submission, contact us to scope the work.
Reading the Site, downloading a resource, using a calculator, or sending us a message through a Site form does not create an engineer-client, professional, contractual, or fiduciary relationship between you and Draftech. No such relationship is formed until Draftech and you have executed a written agreement and Draftech has confirmed the engagement in writing.
Until that point, please do not send us confidential or proprietary project information through the Site, and understand that we owe you no professional duty of care with respect to material published here.
We work to keep the Site accurate and current, but engineering standards, funding program rules, utility requirements, and permitting practices change, and errors and omissions can occur. Content may be out of date by the time you read it.
The Site and all content on it are provided "as is" and "as available," without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error free.
You are responsible for verifying any figure, method, standard, or requirement against the governing code, the utility or agency of jurisdiction, the manufacturer specification, and a licensed engineer before relying on it. To the fullest extent permitted by law, Draftech is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of, or reliance on, the Site or its content.
The Site publishes screening calculators, including the pole loading calculator and the PON power budget calculator. These tools apply simplified, generalized assumptions to the numbers you enter.
Calculator output is for preliminary screening and budgeting only. It is not a pole loading analysis of record, not an optical link budget certification, and not a substitute for analysis in a qualified engineering platform, for field verification, or for review by a licensed professional engineer. Do not use calculator output as the basis for construction, attachment applications, make-ready billing, material procurement, or any submission to a utility, permitting authority, or funding agency.
We make no representation that any calculator reflects the current edition of any code or standard, the loading criteria of any specific utility, or the conditions of your project. Results are unverified until an engineer reviews them against project data.
The Site includes contact, careers, vendor, and resource request forms. Submissions are relayed to our email inbox by a third-party form delivery service; how we handle the personal information in them is described in our Privacy Policy.
By submitting through a Site form, you represent that the information you provide is accurate, that you are entitled to share it, and that it does not include the confidential information of a third party. Do not submit trade secrets, personal data of others, security sensitive infrastructure records, or anything you need held under a confidentiality agreement. Email and web forms are not secure channels.
Except for personal information, which we handle under the Privacy Policy, any idea, suggestion, comment, or feedback you send us through the Site is submitted on a non-confidential basis, and you grant Draftech a perpetual, royalty free license to use it without obligation or compensation to you. We are under no obligation to respond to, review, or act on any submission.
All content on the Site, including text, articles, checklists, templates, graphics, photographs, diagrams, calculators, page design, and the Draftech name and logo, is owned by Draftech International, LLC or its licensors and is protected by United States and international copyright and trademark law.
You may quote a brief excerpt for commentary, research, or reporting if you attribute it to Draftech International and link to the source page. You may not otherwise copy, reproduce, republish, sell, adapt, or create derivative works from Site content, or use the Draftech name or logo, without our prior written permission.
Third-party names, standards, and software referenced on the Site remain the property of their respective owners. Reference to them is descriptive and does not imply endorsement or affiliation.
The Site links to third-party websites, standards bodies, agencies, and service providers for convenience. We do not control those sites, do not endorse their content, and are not responsible for their availability, accuracy, or practices. Your use of a third-party site is governed by that site's own terms and privacy policy.
We may revise these Terms from time to time. Revisions take effect when posted, and we will update the "Last updated" date at the top of this page. Your continued use of the Site after a revision constitutes acceptance of the updated Terms. Please review this page periodically.
These Terms and any dispute arising out of or relating to them or to the Site are governed by the laws of the State of Florida, without regard to its conflict of law rules. You agree that the state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction and venue over any such dispute, and you consent to personal jurisdiction there.
If any provision of these Terms is held unenforceable, the remaining provisions stay in full force. Our failure to enforce a provision is not a waiver of it.
